It simply says the right shall not be suspended” except in cases of rebellion or invasion.”So I guess we just let AG Gonzales decide who has the right of habeas corpus and who doesn't.

Attorney General Gonzales Interprets the Constitution
I wonder if Alberto took an oath to uphold and defend the US Constitution. Here is his interpretation of Article I, section 9 of the Constitution.
